Terms & Conditions – Mexico Rentals Direct
Definitions:
Owner – Owner of the property that is listing on this website
Guest – The guest or renter who books directly with the owner to rent the property.
Payments can be made by: Credit Card (Visa, MasterCard, American Express) or Internet Money Transfer PayPal directly to the owner. Mexico Rentals Direct take on no responsibility for payments from the Guest to the Owner.
All reservations and payments with the owner are governed by the conditions that owner may set from time to time and detailed in the rental agreement between the Owner and the Guest. Mexico Rentals Direct take no responsibility between the arrangements made between the Owner and the Guest at any time, including reservations, payments, cancelations, damages or refunds.
The terms and conditions of the use of this booking website is purely to facilitate booking and communication between the Guest and the owner that is executed by and between the Guest” and the property owner.
Mexico Rentals Direct takes no listing fee or commission from any booking or reservation. Mexico Rentals Direct charges a monthly membership fee directly to the owner to facilitate listing of their property on this website.
Terms & Conditions of Rental
Reservation Deposit — The reservation deposit amount and payment schedule will be defined by the property owner and clearly stated in the rental agreement provided to the Guest. All payments made are made directly to the owner and are non-refundable except as explicitly provided in the rental agreement.
Damage Deposit / Waiver — The property owner will communicate the specific damage deposit or damage waiver amounts and terms directly to the Guest, either in the rental agreement or through separate owner-guest communication that is mutually agreed upon. The Guest remains financially and legally responsible for all damage to the property, including common areas, beyond any waived or deposited amount. Any excess damages will be charged to the Guest’s credit card on file or collected by the owner as provided in the rental agreement.
Damages include, but are not limited to:
- Exceeding the maximum allowed occupancy
- Violating building, condominium, or homeowners’ association rules
- Smoking inside the property
- Unauthorized pets
- Parties or gatherings with excessive people
- Noise disturbances
- Illegal or immoral acts
- Maintaining hazardous, poisonous, corrosive, or flammable substances
Damages do not include intentional illegal acts such as theft, vandalism, or arson, which remain fully the Guest’s responsibility and may be reported to authorities.
Refunds and Cancellations — The specific refund and cancellation policies for each booking will be defined by the property owner and clearly stated in the rental agreement provided to the Guest.
Hurricane / Force Majeure Policy — Mexico Rentals Direct nor the property owners do not offer refunds or rescheduling due to hurricane activity, tropical storms, or other natural events unless explicitly stated otherwise in the rental agreement.
Liability and Indemnity — Neither Mexico Rentals Direct, the property owner(s), nor their agents shall be responsible for any accidents, injuries, illness, death, theft, loss of personal items, or damages occurring before, during, or after the Guest’s occupancy. The Guest assumes all risks associated with the use of the property and any activities undertaken during the stay (including but not limited to swimming in pools or the ocean, water sports, scooter/motorcycle/ATV rentals, horseback riding, SCUBA diving, deep-sea fishing, or other recreational activities common in Mexico).
The Guest agrees to indemnify and hold harmless Mexico Rentals Direct and the property owner(s) from any claims, losses, or liabilities arising from the Guest’s use of the property or actions of the Guest or their party.
Physical Disabilities / Accessibility — Many properties and facilities in Mexico do not fully conform to international accessibility standards (such as those in Canada, the U.S., or Europe). Guests with specific accessibility needs should contact us prior to booking to discuss options.
Proof of Citizenship and Entry Requirements — Guests are responsible for obtaining and presenting valid travel documents (including passports for all travelers, including infants and children). Mexico Rentals Direct and property owners are not liable for any denial of entry or related issues.
Use of the Property — The property shall be used solely for residential vacation purposes. Guests must comply with all applicable laws, ordinances, condominium rules, and homeowners’ association regulations. Smoking is not permitted indoors; a cleaning/ionization fee may apply if smoking is detected (unless otherwise specified in the rental agreement). Unauthorized parties, excessive noise, or illegal activities are prohibited and may result in immediate eviction without refund, plus any applicable damages or fines.
Responsibility for Damages and Personal Property — The Guest assumes all risk of damage to the property, its furnishings, and their own personal belongings. Guests agree to leave the property in the same condition as received, normal wear and tear excepted.
Governing Law and Venue — These Terms & Conditions shall be governed by the laws of Mexico, specifically those applicable in the state of Quintana Roo. Any disputes arising from a booking shall be resolved exclusively in the courts of Playa del Carmen, Quintana Roo, Mexico.
Privacy Policy: Mexico Rentals Direct only collects booking information details and after the booking is completed, this information is deleted from our system. Payment information is communicated directly to the property owner and the property owner accepts full responsibility for the safe keeping of this information.
